E-shop conditions

The online shop www.cartur.ee is operated by the enterprise Tornikivi OÜ, with the Estonian business registry code 14665619 and the address Metsa 43, the town Kärdla, Hiiumaa municipality, Hiiumaa county, postal code 92413.

1.General provisions

1.1 The general terms and conditions of the online shop apply to each and every person (hereinafter referred to as a User of the service) who wishes to purchase products using the online shop www.cartur.ee (hereinafter referred to as the Provider of the service).

1.2 In addition to the present terms and conditions, the legal relationships that arise between the User of the service and the Provider of the service in case of a purchase are regulated by the laws and regulations of the Estonian Republic as well as the general code of good behaviour.

1.3 The Provider of the service has the right to change the service of the online shop whenever the Provider considers it necessary.

1.4 The Provider of the service has the right to unilaterally change the terms and conditions of the user agreement without any obligation to inform the User of the service about that by e-mail.

2. Products and purchasing

2.1 The products that are displayed in the online shop are available in the storage or can be ordered within the given delivery time. The availability of the products displayed in the online shop can change due to technical problems in the programmes of the storage or of the online shop.

2.2 If a product is not present in the storage and it is impossible to deliver the order, a shop assistant of the online shop will contact the user and offer a possible new delivery date or will offer to substitute the product with an equivalent product that has the same price and the same quality, or to refund the money. The money will be refunded to the User of the service within 14 days.

2.3 The pictures displayed are illustrative and the actual product may differ from them.

2.4 The Users of the service will choose the desired products. They are obliged to enter the necessary data (first name, surname, telephone number, e-mail address, address of delivery), and will pay for the products by a bank transaction.

2.5 The User of the service is obliged to provide correct data at the formalisation of the order, that are necessary for the delivery of the order. The Provider of the service is not responsible for interrupted delivery or any other consequencies due to incorrect data that the User of the service has provided.

2.6 The act of selling takes place when the User of the service has confirmed the order through the website of the online shop and has paid for it.

3. Prices

3.1 All the prices in the online shop are presented in euros.

3.2 The Provider of the service has the right to change the prices shown in the online shop whenever the Provider considers it necessary. If prices in the online shop have been altered after a User of the service has placed an order and paid for that, the Provider of the service will be obliged to deliver the products concerned to the User of the service for the prices that were current at the moment of placing the order (unless the price of the product was erroneous, e.g. by mistake a price had been shown as 0 euro). The User of the service has no right to demand any compensation for the price difference.

4. Description of methods of payment and the currency

4.1 It is possible to pay in the online shop of www.cartur.ee through the safe Payment centre (Maksekeskus), using any Estonian payment card and internet bank account (Swedbank, SEB, Luminor, LHV, Coop Pank, Pocopay).

4.2 The currency of settlement is EURO.

5. Delivery

5.1 The User of the service can choose between six different ways of delivery.

5.2 The goods are delivered to Estonia through the mediation of Omniva, Itella smartpost and DPD Eesti parcel terminals and Omniva courier.

5.3 The goods are delivered out of Estonia through the mediation of Omniva.

5.4 After the confirmation of the order and the payment, the goods will be delivered to the User of the service according to the way of delivery chosen by the User, either by the postal service of Omniva, Itella Smartpost or DPD within 1-5 working days in Estonia or 7-28 working days outside Estonia.

5.5 Normally, the Provider of the service will post the product (products) within one day from the receipt of the payment.

5.6 In the borders of Estonia, the product will reach its destination within no more than 5 working days after the ordered product has been sent.

5.7 If the User of the service chooses "I will collect it myself - Hiiumaa" as the way of delivery, the duty of the User of the service will be to collect the goods at an address agreed on, on Hiiumaa, in Kärdla within the period of no more than 5 working days.

5.8 The costs of the postal service will be covered by the User of the service. The costs of the postal service will be added to the conformation of the order of the product.

6. Compilation of the order

6.1 A User of the service will choose the desired products, will determine the quantity of the product and will choose the way of delivery and will confirm the order.

6.2 With the formalisation of the order the Users of the service will affirm that they agree on the user terms and conditions of the online shop and are obliged to follow them.

6.3 At the formalisation of the order the User of the service is obliged to provide the data necessary for the execution of the order: first and surname, telephone number, e-mail address and the place where the goods should be delivered in an automated parcel terminal.

6.4 In case the data provided by the User of the service are erroneous and/or incomplete, the Provider of the service cannot guarantee the expected execution of the order and the delivery at the destination address. If possible, the Provider of the service will contact the User of the service to specify the erroneuous or incomplete data.

6.5 An order confirmed by the User of the service can be paid for by a bank transaction.

6.6 The order will take effect after the payment for the goods has been transferred on the bank account of the Provider of the service.

7. Withdrawal from contract

7.1 If Users of the service wish to withdraw from the contract, after they have placed the order and before the Provider of the service has executed the order, they are obliged to inform the Provider of the service about that in a written form as soon as possible. The written message should be sent by e-mail to the address info@cartur.ee. In the e-mail, the number of the order from which one wishes to withdraw should be mentioned, as well as the contact details of the User of the service (first name, surname, the date of placing the order, telephone number).

7.2 If the application of withdrawal reaches the Provider of the service after the Provider of the service has executed the contract, the withdrawal from the contract will take place according to the rules regulated under the subtitle ”Return of products” of the user terms and conditions of the online shop.

7.3 The Provider of the service will transfer the amount of money back to the account of the User of the service within 30 days from receiving the wish of withdrawal from the contract.

7.4 The amount of money will be transferred to the same bank account where the Provider of the service received it from.

8. Return of products

8.1 The right to return products purchased from the online shop is valid for 14 days.

8.2 The product returned must be faultless, complete, in the original packaging and unused.

8.3 To return a product, one must file an application on the e-mail address info@cartur.ee.

8.4 Returning a product, one must present the invoice of the purchase of the goods.

8.5 In case of returning, the money will be transferred back to the bank account of the User of the service within 30 days from the returning of the product.

8.6 The amount of money will be transferred to the same bank account where the Provider of the service received it.

8.7 In case of withdrawal from contract by the buyer and returning the goods, the postal or courier service costs will not be refunded.

8.8 In case it appears after the return of the product that the product does not comply with the points 8.1 – 8.4 of the user terms and conditions of the online shop, the money will not be refunded to the User of the service and the product will be deposited with the Provider of the service. The costs of depositing the product or returning it to the User of the service will be covered by the User of the service.

9. The order of making complaints

9.1 For the products sold through the online shop, the limited period of 2 years for filing complaints is applicable according to § 218 subsection 2 of the Estonian Law of Obligations Act.

10. Processing personal data

10.1 Processing personal data has been described under privacy policy. privaatsuspoliitikas.

10.2 Using the www.cartur.ee online shop, Users of the service agree clearly and consciously that the Provider of the service will process their personal data.

10.3 The source of personal data is the coming into existance of a client relationship at the registration of an order in the online shop.

10.4 The personal data will be processed by Tornikivi OÜ.

10.5 All saved data connecting to the Provider of the service will be considered confidential information and they must remain unavailable for third persons.

11. Responsibility

11.1 The responsibility of the Provider of the service is limited to the selling price of the product. The Provider of the service does not accept responsibility for any damage caused by faulty products.

11.2 Using the service of the online shop, the User of the service is obliged to follow the legislation and the general code of good behaviour.

11.3 The User of the service is solely responsible for purchasing and maintenance of the software communication systems necessary for using the online shop as well as for other costs caused by the usage of the online shop.

11.4 The User of the service is fully responsible for damages that have been caused to the Provider of the service, other users of the service or third persons by using the online shop in a way that violates the user terms and conditions of the online shop, the legislation or the code of good conduct.

12. User terms and conditions

12.1 Examination of the user terms and conditions of the online shop is obligatory for a User of the service.

12.2 Placing an order, Users of the service declare that they have examined the user terms and conditions of the online shop, that they have understood them and agree on them, by putting a tick in the window ”I declare that I have examined the user terms and conditions of the online shop of www.cartur.ee and I agree on them”.

The user terms and conditions of the online shop www.cartur.ee are valid since June 29, 2020.
